1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of FoodPhoto.ai (the "Service"), operated by FoodPhoto.ai ("we", "our", or "us"). By creating an account, purchasing credits, or using the Service in any way, you agree to these Terms. If you use the Service on behalf of a restaurant or other business, you confirm you are authorized to bind that business to these Terms.

If you do not agree to these Terms, do not use the Service. Our Privacy Policy and Refund Policy also apply to your use of the Service and are incorporated into these Terms.

2. The Service

FoodPhoto.ai is an AI photo enhancement service for food businesses. You upload photographs of real dishes, and the Service uses artificial intelligence to produce enhanced, menu-ready versions — improving lighting, color, background, crop, and presentation while aiming to preserve the actual dish, portion, and ingredients ("Enhanced Images"). The Service is available through the web app and mobile apps.

AI output varies. We do not guarantee that any particular enhancement will meet your expectations, match a specific style exactly, or be accepted by any third-party platform. Where a result is unusable, see our Refund Policy for how we handle it.

3. Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase credits or subscriptions. We may suspend or terminate accounts that violate these Terms.

4. Credits, subscriptions, and billing

Credits. The Service operates on credits: one credit is consumed for each AI enhancement you run. Credits are deducted when processing starts.
One-time packs. Credit packs (such as the Try Pack) are one-time purchases. Pack credits do not expire while your account remains in good standing.
Subscriptions. Monthly plans add a fixed number of credits to your account each billing cycle and renew automatically until you cancel. Unused subscription credits roll over while your subscription is active. You can cancel at any time from your account settings; cancellation stops future renewals and takes effect at the end of the current billing period.
Payments. Payments are processed by Stripe. We do not store full card numbers. Prices are shown at checkout and on the pricing page; we may change prices for future purchases, never retroactively for an already-paid period.
No free trial. The Service does not include a free trial. The free demo on the website is limited, watermark/preview oriented, and offered as-is.

5. Your content

You retain all rights to the photographs you upload ("Input Images"). You grant us a limited, worldwide, non-exclusive license to host, process, and transform Input Images solely to operate the Service (including generating Enhanced Images, providing support, and preventing abuse). You represent that you own or have the necessary rights to the Input Images and that they do not infringe anyone else's rights.

6. Enhanced Images — ownership and commercial use

Subject to your payment of the applicable credits, we assign to you all rights, title, and interest we may hold in the Enhanced Images you generate, to the extent permitted by law. You may use Enhanced Images for any lawful commercial purpose, including:

Delivery platform listings (DoorDash, Uber Eats, Grubhub, Zomato, Deliveroo, and others)
Printed and digital menus, QR menus, and online ordering pages
Websites, Google Business Profile, social media, and advertising
Packaging, signage, and other marketing materials

No attribution is required. Enhanced Images are delivered without watermarks on paid plans. Note that the legal status of AI-assisted images (including copyright registrability) varies by jurisdiction and may depend on the degree of human authorship; we cannot guarantee that an Enhanced Image is copyrightable in your jurisdiction.

7. Honest representation of food

The Service is designed to enhance photos of real dishes, not to fabricate them. You are responsible for ensuring that images you publish fairly represent the food customers actually receive and comply with the rules of each platform where you publish them and with applicable consumer-protection and advertising laws. 8. Acceptable use

You agree not to:

Upload content you do not have rights to, or content that is unlawful, deceptive, or harmful
Use the Service to create images intended to materially mislead customers about what they will receive
Reverse engineer, scrape, overload, or interfere with the Service or its security
Resell or provide automated access to the Service without our written consent
Circumvent demo limits, credit accounting, or other technical restrictions

9. Intellectual property

The Service itself — including software, models, prompts, designs, and branding — is owned by us or our licensors and is protected by intellectual-property laws. Except for the rights to Enhanced Images described in Section 6, nothing in these Terms transfers any of our intellectual property to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ENHANCED IMAGES WILL MEET YOUR REQUIREMENTS OR THE REQUIREMENTS OF ANY THIRD-PARTY PLATFORM.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms. On termination for breach, unused credits may be forfeited. Sections 5–11 survive termination.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Material changes will be communicated by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
